Welcome to haircut.gg ("the Service"), an AI-powered platform that generates hyper-realistic haircut portraits from user-uploaded photos. These Terms of Service ("Terms") govern your use of the Service. By accessing or using the Service, you agree to be bound by these Terms.

In these Terms, "we," "us," and "our" refer to haircut.gg, a sole proprietorship operated by Kirill Melkozerov and based in Yerevan, Armenia. "You" and "your" refer to the user of the Service.

2. Description of Service

haircut.gg provides an AI-assisted tool for visualizing how you would look with different hairstyles and colors. The Service uses artificial intelligence to generate personalized haircut portraits from photos you upload. Please note and acknowledge:

  • The Service generates AI-created portraits for visualization purposes only and does not guarantee that a hairstylist can replicate the exact results shown.
  • Image generation involves sending your uploaded photo to third-party AI providers (Replicate) for processing.
  • The AI-generated images are artistic renderings and may not perfectly reflect real-world results.
  • The Service operates on a one-time payment model where you purchase a "Style Pack" to generate a gallery of portraits.
  • Different coloring techniques generate different numbers of haircut variations - the number of portraits you receive depends on the specific coloring technique you select.
  • Results typically take 2-10 minutes to generate and will be delivered to your email.

3. Age Restrictions

You must be at least 16 years old to use this Service. By using haircut.gg, you represent and warrant that you are at least 16 years of age. If you are under 16 years old, you are not permitted to use the Service.

4. User Responsibilities and Prohibited Uses

As a user of haircut.gg, you agree to and acknowledge the following:

4.1 General Responsibilities

  • You will provide accurate and truthful information when using the Service.
  • You will only upload photos of yourself or photos for which you have explicit permission from the subject.
  • You will use the Service in compliance with all applicable laws and regulations.
  • You will maintain the confidentiality of your account credentials.
  • You understand that the AI-generated portraits are for personal, non-commercial visualization purposes.

4.2 Prohibited Uses

You agree NOT to use the Service for any of the following purposes:

  • Uploading photos of minors (persons under 16 years of age) without verifiable parental or guardian consent.
  • Uploading photos of other people without their explicit permission.
  • Uploading photos of celebrities, public figures, or other individuals for impersonation or fraudulent purposes.
  • Uploading sexually explicit, offensive, discriminatory, or otherwise inappropriate images.
  • Using the Service to create deepfakes, misleading content, or any content intended to deceive or harm others.
  • Uploading copyrighted images that you do not own or have permission to use.
  • Attempting to reverse engineer, manipulate, or exploit the Service's AI systems.
  • Using the Service for any illegal, harmful, or abusive purposes.
  • Violating any person's privacy, publicity, or intellectual property rights.

We reserve the right to refuse service, delete content, and terminate accounts that violate these prohibited uses without refund.

5. Data Processing and Privacy

We process your data to provide the Service. By using haircut.gg, you acknowledge and agree that:

  • Your uploaded photos will be sent to third-party AI providers (Replicate) for image generation.
  • Your photos and generated portraits are stored securely for 30 days to allow you access to your personal gallery.
  • After 30 days, your original photo and all generated portraits are automatically and permanently deleted from our servers.
  • We will never use your photos for any purpose other than providing the Service to you.
  • We will handle your data in accordance with our Privacy Policy, which is incorporated by reference into these Terms.
  • While we take reasonable measures to protect your data, we cannot guarantee absolute security of information transmitted over the internet.
  • You are solely responsible for ensuring that your use of the Service complies with all applicable data protection and privacy laws.

6. Payment, Billing, and Refunds

  • haircut.gg operates on a one-time payment model. Users purchase a "Style Pack" for $14.90 to generate a gallery of AI portraits (the exact number depends on the coloring technique selected).
  • Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. By making a purchase, you agree to Paddle's terms of service in addition to these Terms.
  • Prices are as listed on our website and may be changed at any time, though changes will not affect purchases already made.
  • Additional services such as "Color Refresh" packs or "New Style Packs" may be offered at different prices.

6.1 Refund Policy

IMPORTANT: Loss of Right of Withdrawal for Digital Content

haircut.gg provides digital content that is immediately made available upon generation. By initiating the AI generation process (i.e., by clicking to generate your haircut portraits), you consent to immediate performance of your purchase and acknowledge that you will lose your right of withdrawal once the generation and transmission of the digital content has begun. This acknowledgment is required under consumer protection laws for digital content services.

Once the AI generation process has begun and digital content has been transmitted to you, any refunds are provided at the sole discretion of haircut.gg and Paddle (our payment processor), on a case-by-case basis. We may offer refunds in the following situations within 14 days of purchase:

  • Full Refund (Pre-Generation): If you request a refund within 14 days BEFORE initiating the AI generation process (i.e., before any AI generation has been performed), you retain your right to cancel and receive a full refund.
  • Full Refund (Post-Generation, Discretionary): If the AI generation process fails completely and no portraits are successfully generated, we will typically provide a full refund.
  • Full Refund (Post-Generation, Discretionary): If persistent technical problems prevent you from accessing your gallery or receiving your portraits, we will typically provide a full refund.
  • No Refund: If more than 14 days have passed since your purchase, refunds will not be provided.
  • No Refund: If you have violated these Terms of Service or we have detected refund policy abuse.

Refund Request Process

  • Refund requests must be submitted in writing to [email protected] within 14 days of your purchase.
  • Please include your order number and reason for the refund request.
  • Refund requests will be reviewed within 2-3 business days of receipt.
  • Approved refunds will be processed through Paddle and may take up to 14 business days to appear on your statement.
  • All refunds will be issued in the original currency of purchase using the same payment method as the original transaction.
  • Paddle, as our Merchant of Record and payment processor, reserves the right to refuse refund requests if they find evidence of fraud, refund abuse, or other manipulative behavior.
  • Upon processing a refund, all your photos and generated images will be immediately and permanently deleted from our servers.

To maximize your satisfaction and minimize the need for refunds, please follow our photo upload guidelines:

  • Upload a clear, high-quality photo where you are looking directly at the camera
  • Ensure good, even lighting
  • Avoid photos with sunglasses, hats, heavy shadows, or extreme angles
  • Use a recent photo that clearly shows your face

7. Intellectual Property

7.1 Service Ownership

The Service, including its software, design, branding, and website content, is owned by haircut.gg and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of our Service without express written permission.

7.2 Your Generated Images

  • You retain ownership of the photos you upload to the Service.
  • You are granted a personal, non-exclusive, non-transferable license to use the AI-generated portraits for personal, non-commercial purposes.
  • The generated portraits may be used for personal reference, sharing with friends and family, or showing to your hairstylist.
  • You may not use the generated portraits for commercial purposes, advertising, or any purpose that violates these Terms.
  • By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to store and process your photos and generated images solely for the purpose of providing the Service to you.

8. Disclaimers and Limitations of Liability

8.1 Service Disclaimers

  • The Service is provided "as is" and "as available" without any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We do not guarantee that the AI-generated portraits will be completely accurate or that a hairstylist can perfectly replicate the results.
  • We do not guarantee that the Service will be uninterrupted or error-free.
  • The AI-generated images are artistic interpretations and visualizations, not guarantees of real-world results.
  • We expressly disclaim any guarantee regarding your satisfaction with a haircut obtained based on our generated portraits.

8.2 Limitations of Liability

  • haircut.gg shall not be liable for any consequences resulting from your use of the Service or decisions made based on the AI-generated portraits, including but not limited to dissatisfaction with a haircut obtained, damage to your hair, or professional outcomes.
  • To the fullest extent permitted by applicable law, haircut.gg, its operators, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
    • Your use or inability to use the Service
    • Any AI-generated content obtained from the Service
    • Unauthorized access, use, or alteration of your transmissions or content
    • Decisions made by you or third parties (such as hairstylists) based on the generated portraits
    • Technical failures, delays, or errors in the generation process
  • In no event shall our total liability for all claims related to the Service exceed the amount paid by you for accessing the Service (i.e., $14.90 or the applicable purchase price).
  • You expressly understand and agree that haircut.gg shall not be liable for any damages or losses resulting from your reliance on the generated portraits or the use of the Service for any purpose.

9. Indemnification

You agree to indemnify, defend, and hold harmless haircut.gg, its operators, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including privacy, publicity, or intellectual property rights
  • Any photos you upload to the Service
  • Any misuse of the AI-generated portraits

10. Termination

10.1 Termination by Us

We reserve the right to suspend or terminate your access to the Service at our sole discretion, with or without notice, for any violation of these Terms or for any other reason, including but not limited to:

  • Uploading prohibited content
  • Fraudulent activity or abuse of the refund policy
  • Violation of intellectual property or privacy rights
  • Use of the Service for illegal purposes

10.2 Effect of Termination

Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. Upon termination for violation of these Terms, you forfeit access to your gallery and any refund rights, except as required by applicable law.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the Republic of Armenia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Yerevan, Armenia.

11.1 Dispute Resolution

Before resorting to formal court proceedings, both parties agree to attempt to resolve any disputes through good-faith negotiations. You may contact us at [email protected] to initiate dispute resolution discussions.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

13. Modifications to the Terms of Service

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by:

  • Posting the updated Terms on our website with a new "Last updated" date
  • Sending an email notification to registered users (if applicable)
  • Displaying a notice on the Service
